The Latest Regulation On The Work Permit

THE LATEST REGULATION :
For expatriates occupying the office of member of board of directors & commissioners with their domicile overseas are obligated to have IMTA and pay the fund of DPKK USD 1,200 per year.


The Ministry of Labor now has issued the latest Regulation No. 16 Year 2015 that has been validated as of the 29th of June 2015, concerning the procedures on the employment of expatriates. By the issuance of this regulation, therefore as of the 29th of June 2015 expatriates occupying the office of member of board of directors such as Director and Commissioner living or domiciling overseas are obligated to have IMTA and paying the fund of DPKK in the amount of USD 1,200 per year to the Ministry of Labor, pursuant to the regulation of minister No. 16 article 37 paragraph 2 year 2015.

As the consequence of validating this regulation therefore for those who just handling their IMTA on this month of September, then besides having to pay USD 1,200 also they also must pay the penalty of USD 100 for the delay each month. If IMTA is just handled on the month of September then the penalty to be incurred is in the amount of USD 400 thus the Company must pay USD 1,600.

Before the existence of this regulation, members of board of directors and commissioners such as Director and Commissioner not actively working in Indonesia and domiciling overseas are not obligated to have work visa and work permit / IMTA and not obligated to pay DPKK in the amount of USD 1,200 per year. But by the issuance of this regulation, therefore all members of directors must have 1 year work visa (type 312) and paying compensation fund DPKK USD 1,200 per year in order to obtain IMTA from the Ministry of Labor/ DEPNAKER.
